  1. Jerry Ackerman Excellent point Jerry! I don't know where the username and password is if they gave it to me - what's the full reference to section d. above? I'll ask the HICV lawyer about it. Also, is there a date on the disclosure guide that has the new restrictions?

  2. Jerry Ackerman Got a good response on TUG:

"You have a deeded right to rent what you own. HICV exchange program is the points program and like RCI, etc they can restrict your ability to rent what you obtain through their internal exchange program. So you can secure your home fixed or float week and go to town renting it. The Club and reservations you obtain through the club though is what they are restricting your ability to rent."

  3. I believe the issue is very much in the gray area. The points program came after the weeks. It is very clear in the original contract that you have no restrictions on rentals.

The points program simply a different way to subdivide the original program so I do not see how they can supersede your rights by changing the program.

It is a very grey area and I think HIVC is aware of this. I believe we could get a class action law suit on this giving us the ability to match what every HIVC can bring to the table. Combine that with the damage they will receive in the press and I am not sure they want to go there. Who knows, we will have to wait until they try to enforce there position. At that point we will need to bring suit and try to convert it to class action.

I am starting to understand why they are trying to stop rentals. Imagine a time when they have to compete to buy back contracts because the value of the rental. They could find themselves in a time where they have lost control of the enterprise.
